DOSSIER No: 00 10 61 SMITH, Ross Applicant c. PUBLIC PROTECTOR Public body _________________________________________________________________________ DÉCISION ____________________________________________________________ On September 11, 2001, the applicant was ordered : to state, in writing and before November 2001, the reasons for which a specific decision, made by the person in charge of access to documents for the Public Protector, should be reviewed by the Commission; to send his statement to the Commission and to the Public Protector. The applicant failed to comply with this order. The Commission therefore believes that its intervention for a review would clearly serve no purpose. Pursuant to section 130.1 of the Act respecting Access to documents held by public bodies and the Protection of personal information, the Commission refuses to examine the application for review made by the applicant : 130.1 The Commission may refuse or cease to examine a matter if it has reasonable cause to believe that the request is frivolous or made in bad faith or that its intervention would clearly serve no purpose. HÉLÈNE GRENIER Commissaire Québec, le 5 novembre 2001.
